The house was built in 2007 and should be on the 2003 IRC. I am moving and do not have my code books where I am at. Thanks for the help. As I recall, the prohibition on overcurrent devices over stairways didn't make it into the NEC until the 2008 edition. I'm not sure that it's ever made it into the IRC. So, no, it was ok in 2007.
